Puppy Contract

This agreement is made and entered into this ___ day of ____________________, 2007 by and between Kristen Reiter, DVM (Seller) and ____________________ (Buyer), for the purpose of setting forth the terms and conditions of purchase by the Buyer of a purebred Labrador Retriever from the litter whelped on _____________________________ 2007 out of Ridge View Amazin Perfection and by Am/Can CH HiltonHall Sammy’s Keepsake, JH.

For $___________, the seller agrees to sell and the buyer agrees to purchase a companion puppy from the litter described above subject to the following terms.

1. Seller warrants that the above-described puppy/dog is a purebred Labrador Retriever eligible for limited registration with the American Kennel Club and that registration papers will be provided to the Buyer as of the date of the completed purchase, together with a true copy of its pedigree.

2. Seller warrants that the above-described puppy/dog is in good health at the time Buyer assumes ownership. Buyer agrees to have the puppy examined by a licensed veterinarian within 72 hours (not including weekends or holidays) of receipt of the puppy/dog.

If, as a result of the examination, the veterinarian determines that the puppy/dog is not in good health then the Buyer shall elect to keep the puppy/dog or return the puppy/dog to the Seller for a refund. If the Buyer elects to return the puppy, Buyer shall, within 10 days after the date of the signing of this contract, send to Seller by certified mail a written veterinarian’s certificate stating that the puppy/dog was in ill health when examined. Upon receipt by Seller of said certificate, Buyer shall be obligated to return the puppy/dog to Seller at Buyer’s expense. Upon receipt of the puppy/dog, the Seller shall be obligated to refund all monies received from Buyer toward the purchase price of the puppy/dog, and further performance under this contract shall be null and void. All action taken to return the puppy/dog shall be done with the best interest of the puppy/dog in mind including temperature at the time of shipment and non-stop air flights.

3. Seller warrants that the puppy/dog sold hereunder is progeny of animals radiographed and certified by the Orthopedic Foundation for Animals to be certified clear of hip and elbow dysplasia. In addition, the breeding animals are examined and found to be free of heritable ocular conditions by a board-certified ophthalmologist and are certified by the Canine Eye Registration Foundation. If said puppy/dog develops hip or elbow dysplasia or develops an ocular condition that is deemed to be inherited within 18 months from date of birth, the Buyer will receive a replacement puppy/dog of like quality from the next available litter for one-half the original purchase price. Should the inherited condition become so severe that the affected puppy/dog must be humanely destroyed, the dog will be replaced at no charge. If a show quality dog is found to have inherited hip dysplasia or ocular disease after it has finished its Championship, it will be replaced at no charge. Buyer is responsible for any resulting shipping costs. Please refer to “Limited Guarantee” contract for further information on this topic.

4. Ownership of the puppy/dog will be transferred to the Buyer for the sale price of $___________ to be paid as follows: $250 deposit on execution of the Agreement with the balance of $______ to be paid on or before the puppy/dog leaves the Seller’s premises. If the balance is not paid by February 10, 2007, this Agreement shall be cancelled and the Buyer forfeits the deposit given hereunder.

The purchase price shall include, in addition to the puppy/dog, the full series of puppy vaccinations to include three vaccinations for Distemper, Hepatitis, Leptospirosis, Parainfluenza, Parvovirus, and Coronavirus, two vaccinations for Bordetella, and one vaccination for Rabies. Fecal floatations shall be performed routinely and puppy/dog shall be dewormed as appropriate and necessary. An AVID microchip shall be placed. Registration of microchip number to Buyer’s contact information shall be at Buyer’s expense. The puppy/dog shall be spayed/neutered by the seller between five and six months of age. In order to reap the benefits of the comprehensive veterinary package, Buyer shall be required to return to SunDog for completion of vaccination series and the spay or neuter surgery. In the event that the Buyer opts to present the puppy/dog to their local veterinarian for administration of the vaccination series or performance of the spay/neuter, no discounts shall be presented for services not performed by SunDog.

5. If delivery is requested by Buyer, it shall be by airfreight, COD to a designated location. Buyer is responsible for costs of crate, insurance during shipment, and cost of freight charges. If Seller has to purchase a crate prior to shipping, Buyer shall reimburse Seller in full for this cost.

6. The Seller is selling this puppy/dog as a companion dog. As such, the puppy/dog shall be spayed/neutered prior to leaving the possession of the Seller and the Buyer shall be provided with a Limited Registration Certificate.

7. Puppy/dog will carry the SunDog name. Failure to include SunDog in the registered name of the animal will render the Limited Health Guarantee null and void.

8. Buyer agrees that he/she is not acting as an agent in the purchase of this puppy/dog and that Buyer will not sell this puppy/dog to any agent, pet store or guard dog business.

9. Buyer agrees that if it becomes necessary to sell or otherwise dispose of this puppy/dog, Buyer will notify the Seller before taking such action so that the puppy/dog may, at the Seller’s option, be re-purchased by the Seller at the original sale price. Upon notification, the Seller shall have 15 working days to exercise said re-purchase option. Exercise shall consist of notice in writing sent to Buyer.

10. Buyer agrees that the puppy/dog will reside in the home of the Buyer, have access to consistent exercise, not be chained or tethered, and will be provided with proper housing, a good quality diet, annual vaccinations and routine veterinary care.

This Agreement is made and signed by both parties to insure the well-being and protection of this puppy/dog. If the Buyer breaches any part of this Agreement, the Seller is released from any obligations under this Agreement.
